When is consent necessary for your drone operations?

If you plan to overfly buildings and residential properties, you must:

  • Inform the residents about the flight.
  • Obtain consent from property owners or residents, according to the regulations applicable to the area where you intend to operate the drone
  • You do not need to obtain consent if you are flying over due to critical infrastructure or if you are permitted to enter the property under other legislation.

Be aware that different rules apply depending on whether the area belongs to the residential property, is owned by the municipality, or consists of condominiums.

If you plan to operate your drone closer than 2.5 meters to residential properties:

  • You must inform the residents about the flight
  • You must obtain consent from property owners or residents, following the regulations applicable to the area where you intend to operate the drone.
  • You do not need to obtain consent if you are flying over due to critical infrastructure or if you are permitted to enter the property under other legislation.

Definition of uninvolved person: An uninvolved person is not part of the drone operation taking place in a specific area.

  • You must never fly over a gathering of people
  • You must be aware that, as a rule, there must be no uninvolved persons in the flight and safety area during the drone operations.
  • If there are uninvolved persons in the area, you must ensure that they have given consent for the drone operation to proceed.
  • If an uninvolved person enters the area, you should, as far as possible, avoid overflying them with the drone or land the drone.

How to obtain consent

You must obtain consent before conducting your drone operation to ensure that uninvolved persons, as well as property residents and owners, agree to the flight over them or their property.

Consent must:

  • Contain specific information about what the consent is being given for.
  • Be stored by you if obtained in writing If obtained verbally, you must be able to prove it another way.
  • Be explicitly given (can be verbal) to include the individual in the drone operation.

It is essential that the person, whether they are an uninvolved individual or someone whose property will be overflown by the drone, has received clear instructions and safety measures to follow in case the drone does not behave as expected.

An explicit consent could, for example, involve the drone operator informing a property owner that the property will be overflown on May 1, 2024, in connection with scanning the roof due to damage that needs inspection. The property owner must then provide consent and inform the residents about the overflight.
